These Terms of Use ("Terms") govern your access to and use of the StellarDay mobile application (the "App"), the StellarDay website at stellar-day.com (the "Website"), and any related services (collectively, the "Services") operated by StellarDay ("we," "us," or "our").
By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
1. Eligibility
You must be at least 16 years of age to use the Services. By creating an account or using the App, you represent that you meet this age requirement.
If you are under the age of legal majority in your jurisdiction, you confirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
2. Account Registration and Authentication
To use the App, you must create an account. You can register using your email address and a password, or sign in with your Google account.
When creating an account, you agree to:
- provide accurate and complete information,
- keep your login credentials secure and confidential,
- notify us promptly if you suspect unauthorized access to your account,
- accept responsibility for all activity that occurs under your account.
We reserve the right to temporarily restrict or permanently delete accounts that violate these Terms or pose a risk to the security of the Services.
3. Purpose of the Services and Wellbeing Disclaimer
StellarDay is designed to support personal self-reflection, gratitude journaling, and general wellbeing. It provides tools such as a gratitude journal, daily affirmations, and metaphoric associative cards to help build positive habits.
StellarDay is not a medical, psychological, therapeutic, diagnostic, or crisis service. The App and its content do not constitute professional advice, treatment, or a substitute for qualified care.
If you are experiencing a medical or mental health emergency, please contact a qualified professional or your local emergency services immediately. Do not rely on StellarDay for urgent or clinical support.
4. Acceptable Use
You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:
- use the Services for any unlawful, abusive, or fraudulent purpose,
- upload or store content that is harassing, threatening, defamatory, obscene, or otherwise objectionable,
- upload malware, viruses, or any harmful code,
- attempt to gain unauthorized access to the Services, other users' accounts, or related systems,
- interfere with or disrupt the operation, security, or performance of the Services,
- scrape, crawl, or use automated means to extract data from the Services,
- reverse engineer, decompile, or disassemble any part of the App or its underlying technology,
- submit false, misleading, or fraudulent information.
5. User-Generated Content
The App allows you to create and store content, including gratitude journal entries and photographs ("User Content").
You retain all ownership rights to your User Content. By using the Services, you grant us a limited, non-exclusive, non-transferable license to store, process, back up, and display your User Content solely as necessary to operate the App and provide the Services to you.
We do not access, review, or share your User Content except as required to operate the Services, comply with legal obligations, or respond to your support requests.
You are responsible for ensuring that your User Content does not violate any applicable laws or third-party rights.
6. Account Suspension and Deletion
We may suspend or terminate your account if we reasonably believe you have violated these Terms, engaged in abusive behavior, or if required to do so by law.
You may delete your account and all associated data at any time from within the App by navigating to Settings and selecting "Delete Account." This action is permanent and cannot be undone.

7. Intellectual Property
Unless otherwise stated, all content, features, and functionality of the Services — including text, branding, design elements, graphics, logos, illustrations, software, and other materials — are owned by or licensed to us and protected by applicable intellectual property laws.
You may not copy, reproduce, distribute, modify, publish, or create derivative works from any part of the Services without our prior written permission, except for your own User Content.
8. App Availability and Updates
We strive to keep the Services available and up to date, but we do not guarantee uninterrupted or error-free access.
We may update, modify, suspend, or discontinue the App or any of its features at any time, with or without notice, for maintenance, security, legal, or operational reasons.
Certain features may not be available in all regions or on all platforms.
9. Waitlist
The Website may allow users to join a waitlist to receive updates about StellarDay. Joining the waitlist does not guarantee access to the App, early access, a release date, availability in your country, availability on a specific platform, or access to any specific features.
10. Third-Party Services and Links
The Services may integrate with or contain links to third-party services, such as Google Sign-In. Your use of such services is subject to their own terms and privacy policies. We are not responsible for third-party content, policies, or practices.
11. Privacy
Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.
12. Disclaimer of Warranties
To the maximum extent permitted by law, the Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied.
We do not warrant that the Services will be uninterrupted, secure, error-free, or free from harmful components, or that any information provided through the Services will be complete, accurate, or current.
13. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, goodwill, or business opportunities arising out of or related to your use of or inability to use the Services.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will post the updated version on this page and revise the "Last Updated" date above.
Your continued use of the Services after any update means you accept the revised Terms. If you do not agree to the changes, you should stop using the Services.
15. Governing Law
These Terms shall be governed by the laws of Germany, excluding conflict of law rules, unless mandatory consumer protection law in your jurisdiction requires otherwise.
